The legal stuff, served straight — with sprinkles where the lawyers allowed them. By using this site or placing an order, you agree to these terms.

This website is operated by Evergreen USA LLC (d/b/a Just The Fun Part), 14 Patterson Ave., Hoboken, NJ 07030. Throughout these terms, "we," "us" and "our" refer to Just The Fun Part.

1. Using the site

By visiting our site or buying something from us, you agree to be bound by these Terms of Service. If you don't agree, the cones will be sad, but you should stop using the site. You must be at least the age of majority in your state to make a purchase, or use the site under the supervision of a parent or guardian.

You agree not to misuse the site — no unlawful purposes, no attempting to break, overload, or reverse-engineer it, no transmitting malicious code, and no scraping content for purposes we haven't authorized.

2. Products & pricing

We work hard to display our products, descriptions, and prices accurately, but errors occasionally sneak through (we're better at chocolate than typing). We reserve the right to correct errors, update information, change prices, and cancel orders affected by errors — including after an order is placed. All prices are in U.S. dollars and may change without notice. We may limit quantities per person, household, or order.

Product images are for illustration; the bite-sized joy is real, but colors and exact appearance may vary slightly.

3. Orders

We reserve the right to refuse or cancel any order — for example, where we suspect fraud, error, or resale activity. If we cancel after payment, we'll refund what you paid. You agree to provide current, complete and accurate purchase and account information.

4. Shipping

Delivery timeframes are estimates, not guarantees — carriers gonna carrier. Risk of loss passes to you upon our delivery to the carrier. Full details live in our Shipping Policy; if an order arrives damaged, contact us and we'll make it right.

5. Returns & issues

Because our products are food, we can't restock opened chocolate (and frankly, neither could you). If something's wrong with your order — damaged, incorrect, or missing items — see our Refund & Return Policy or reach out via the contact page and we'll sort it out.

6. Our content

Everything on this site — text, graphics, logos, images, the astronaut, the jokes on the box — is owned by or licensed to us and protected by copyright and trademark law. You may not reproduce, sell, or exploit any portion of the site without our express written permission.

7. Third-party links

Some links may send you to third-party websites. We're not responsible for their content or practices — once you leave our site, their terms apply, not ours.

8. Disclaimers

The site and products are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee the site will be uninterrupted, timely, secure, or error-free. (We do guarantee the chocolate is Belgian.)

9. Limitation of liability

To the maximum extent permitted by law, Just The Fun Part and Evergreen USA LLC shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the site or products. Where liability cannot be excluded, it is limited to the amount you paid for the product giving rise to the claim. Some states don't allow these limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Just The Fun Part, Evergreen USA LLC, and our employees and partners from any claim arising out of your breach of these terms or your violation of any law or third-party right.

11. Allergens & food information

Our products contain milk, wheat and soy, and are made in a facility that handles nuts and sesame. Always check each product page and the package label — the label on the actual bag controls. See the FAQ for the full allergen rundown.

12. Governing law

These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles.

13. Severability & changes

If any provision of these terms is found unenforceable, the rest remain in full force. We may update these terms at any time by posting the revised version here — continued use of the site means you accept the changes.
